Terms of Service

Welcome to Cultivate! These Terms of Service ("Terms") govern your use of the Cultivate app ("App") provided by Cultivate ("we," "us," or "our"). By using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. Use of the App

You may use the App to nurture personal values through a plant-growing metaphor, including adding plants, setting reminders, journaling reflections, earning achievements, and syncing data via iCloud. To access certain features (e.g., unlimited plants, journaling, achievements), you must purchase a subscription (weekly at $3.99) or lifetime access ($29.99).

2. Account and Data

• You are responsible for maintaining the confidentiality of your iCloud account used for data syncing.
• We store your plants, reflections, and achievements in iCloud to sync across your devices. You can export your data as a JSON file.
• You may reset all data within the App, which will permanently delete your plants and associated data.

3. Payments

• Payments for subscriptions and lifetime access are processed via Apple’s StoreKit.
• The weekly subscription auto-renews at $3.99/week unless canceled at least 24 hours before the renewal date.
• Lifetime access is a one-time purchase at $29.99, granting perpetual access to premium features.
• All payments are non-refundable except as required by law.

4. Intellectual Property

All content, designs, and features of the App, including the plant-growing metaphor and flower-themed UI, are owned by Cultivate and protected by copyright laws. You may not reproduce, distribute, or create derivative works without our permission.

5. User Conduct

You agree not to misuse the App, including but not limited to attempting to access features without a subscription, reverse-engineering the App, or using it for unlawful purposes.

6. Termination

We may terminate your access to the App if you violate these Terms. Upon termination, you must cease using the App, but your data will remain in iCloud unless you reset it.

7. Limitation of Liability

The App is provided "as is" without warranties. We are not liable for any damages arising from your use of the App, including data loss due to iCloud sync issues.

8. Changes to Terms

We may update these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms.

Privacy Policy

At Cultivate, we value your privacy. This Privacy Policy explains how we collect, use, and protect your data when you use the Cultivate app ("App"). By using the App, you consent to this Privacy Policy.

• Personal Data: We do not collect personally identifiable information unless you choose to provide it (e.g., email address when contacting support).
• App Data: We collect data you create in the App, including plants (name, health, streak, growth stage), reflections (text entries), and achievements (progress, timestamps).
• Usage Data: We may collect anonymized usage data (e.g., app interactions) to improve the App, but this data is not linked to your identity.

2. How We Use Your Data

• App Functionality: Your plants, reflections, and achievements are stored in iCloud to sync across your devices and enable features like reminders and journaling.
• Support: If you contact support, we use your provided information (e.g., email) to respond to your inquiries.
• Improvement: Anonymized usage data helps us improve the App’s performance and features.

3. Data Storage and Security

• Your data is stored in iCloud, managed by Apple, and is subject to Apple’s privacy and security practices.
• We do not store your data on our servers; it remains on your device and in iCloud.
• We implement reasonable security measures to protect your data, but no system is completely secure. You are responsible for securing your iCloud account.

4. Data Sharing

We do not share your data with third parties except as required by law or to provide App functionality (e.g., iCloud sync via Apple). Anonymized data may be used for analytics but cannot be linked to you.

5. Payments

Payments for subscriptions and lifetime access are processed via Apple’s StoreKit. We do not collect or store your payment information; it is handled by Apple in accordance with their privacy policy.

6. Data Deletion

You can reset all data within the App, which permanently deletes your plants, reflections, and achievements from iCloud. You can also export your data as a JSON file before resetting.

7. Children’s Privacy

The App is not intended for children under 13. We do not knowingly collect data from children under 13. If you believe we have collected such data, please contact us to have it removed.

8. Changes to This Policy

We may update this Privacy Policy at any time. Changes will be reflected on this page, and continued use of the App constitutes acceptance of the updated policy.
